A judge on Tuesday denied a motion by Uvaldo Martinez’s attorney to seal the grand jury testimony of people who testified against the councilman regarding his use of a city credit card for meals.
San Diego Superior Court Judge Richard Huffman ruled that there was no evidence presented to show that release of the transcript would prejudice Martinez’s right to a fair trial on felony charges in connection with the expenses.
Huffman did stay his order unsealing the transcript until 9 a.m. next Tuesday, to allow the councilman’s attorney to appeal the decision to the 4th District Court of Appeal.
Jerry Coughlin, Martinez’s lawyer, said he intends to appeal the ruling.
