A judge refused to dismiss charges against the two remaining defendants in the McMartin Pre-School molestation case but gave the defense a chance to present new arguments for dismissal. Los Angeles Superior Court Judge William Pounders said that, although the arguments in the past two days were insufficient to warrant dismissing the charges against Peggy McMartin Buckey, 59, and her son, Raymond, 27, there are other grounds that attorneys could argue. He scheduled another court session Monday. The judge said he saw possible grounds for dismissal if the attorneys could prove that the government is selectively prosecuting the remaining defendants.
