A split Iowa Supreme Court said a fetus is a “family member,” and parents can collect insurance benefits when the fetus is killed. “A minor child includes an unborn child,” the high court said in a 6-3 decision written by Chief Justice W. Ward Reynoldson. The court said Joan and Michael Craig of Black Hawk County could collect $25,000 they sought from IMT Insurance Co. for loss of the fetus. Court records said Joan Craig was 6 1/2 months pregnant when the car she was driving was struck Dec. 6, 1984, by an uninsured motorist who ran a red light.
