Broderick Case Move

After a series of delays, the murder trial of Elisabeth A. (Betty) Broderick will be assigned to a San Diego judge next Wednesday, Superior Judge Jesus Rodriguez announced on Wednesday.
Rodriguez’s announcement came after the 4th District Court of Appeal denied Broderick’s effort to overturn Rodriguez’s earlier denial of her motion to disqualify the entire San Diego Superior Court bench.
Broderick, 42, is accused of murdering ex-husband Daniel T. Broderick III, 44, and his wife, Linda Kolkena Broderick, 28, last fall. She has pleaded not guilty. Her trial is set for July 16.
Her lawyer, Jack M. Earley, has contended that because Daniel Broderick was a prominent lawyer in San Diego’s “close-knit” legal community, his client cannot get a fair trial before a San Diego judge.
Earley has vowed to challenge the 69 Superior Court judges one by one, if necessary.
