OXNARD : Brother Pleads Guilty in Boy’s Drug Deals

An Oxnard man faces up to 11 years in state prison after pleading guilty to forcing his 12-year-old brother to sell drugs, prosecutors said.

Roberto Guadalupe Avitia, 25, has pleaded guilty to inducing a minor to sell narcotics, and possession of drugs, the district attorney’s office said.

Superior Court Judge Charles W. Campbell Jr. set Avitia’s sentencing for Oct. 13. Avitia’s girlfriend, Maria Racquel Chavez, 21, faces charges of possessing cocaine and heroin and could receive up to five years in prison if convicted.

The 12-year-old boy was arrested Aug. 4 after police raided the family’s apartment. The raid was conducted after the boy sold $60 worth of cocaine during an undercover sting.

The boy told police at the time of his arrest that he sold drugs for his brother and Chavez. But during a preliminary hearing two weeks later, he testified that only his brother instructed him to sell the drugs.
