Rehearing Sought on Decision Blocking Hotel

The federal government is seeking a rehearing from a U.S. 9th Circuit Court of Appeals panel on parts of its decision that could block a planned 350-room hotel and conference center near Sausalito.
The U.S. Department of Justice, which represents the National Park Service, filed its request Monday.
The department is asking the court to review its decision in two areas: that the conference center proposal violates the federal Coastal Zone Management Act by allowing more commercial development than is permitted under a state-approved plan, and that it violates the Marine Mammal Protection Act because it might affect marine mammals.
